Постановление Политбюро ЦК ВКП(б) об утверждении постановления СНК СССР и ЦК ВКП(б) “О порядке производства арестов” 21 июня 1935 года
The Council of People's Commissars of the USSR and the Central Committee of the VKP(b) resolve:
1. Amending the instruction of May 8, 1933, organs of the NKVD may conduct arrests in all cases without exception only with the consent of the corresponding procurator.
2. In cases where it is necessary to make an arrest at the scene of a crime, officials of the NKVD authorized by law to do so are obliged to immediately inform the corresponding procurator of the arrest made, in order to obtain confirmation.
3. Permissions for the arrest of members of the Central Executive Committee of the USSR and of the Central Executive Committees of the union republics shall be granted only upon the organs of the procuracy and the NKVD obtaining the consent of the chairman of the Central Executive Committee of the USSR or the chairmen of the Central Executive Committees of the union republics, as applicable.
Permissions for the arrest of leading officials of the People's Commissariats of the USSR and the union republics and equivalent central institutions (heads of departments and divisions, managers of trusts and their deputies, directors and deputy directors of industrial enterprises, state farms, and the like), as well as engineers, agronomists, professors, doctors, and heads of educational and scientific-research institutions employed at various institutions, shall be granted in coordination with the corresponding People's Commissars.
4. Permissions for the arrest of members and candidate members of the VKP(b) shall be granted in coordination with the secretaries of district, krai, and oblast committees of the VKP(b), and CCs of national communist parties, as applicable; and with respect to communists holding leading positions in the People's Commissariats of the USSR and equivalent central institutions, upon obtaining the consent of the chairman of the Commission of Party Control.
5. Permissions for the arrest of military personnel of the senior, higher, and middle commanding staff of the Red Army shall be granted in coordination with the People's Commissar of Defense.
6. Permissions for arrests shall be granted: in the district by the district procurator; in autonomous republics by the procurators of those republics; in territories and oblasts by the territorial and oblast procurators.
For cases involving crimes on railway and water transport, permissions for arrests shall be granted by district procurators, line procurators, and basin procurators, as applicable; for cases subject to the jurisdiction of military tribunals, by procurators of military districts.
Permissions for arrests conducted directly by the People's Commissariats of Internal Affairs of the union republics shall be granted by the procurators of the republics.
Permissions for arrests conducted directly by the People's Commissariat of Internal Affairs of the USSR shall be granted by the Procurator of the USSR.

Постановление Политбюро ЦК ВКП(б) об утверждении постановления СНК СССР и ЦК ВКП(б) “О порядке производства арестов” 21 июня 1935 года
Совет Народных Комиссаров Союза ССР и Центральный Комитет ВКП(б) постановляют:
1. Во изменение инструкции от 8-го мая 1933 г., аресты по всем без исключения делам органы НКВД могут производить лишь с согласия соответствующего прокурора.
2. В случае необходимости произвести арест на месте преступления уполномоченные на это по закону должностные лица из НКВД обязаны о произведенном аресте немедленно сообщить соответствующему прокурору для получения подтверждения.
3. Разрешения на аресты членов ЦИКа Союза ССР и ЦИКов союзных республик даются лишь по получении органами прокуратуры и НКВД согласия председателя ЦИКа Союза ССР или председателей ЦИКов союзных республик, по принадлежности.
Разрешения на аресты руководящих работников наркоматов Союза и союзных республик и приравненных к ним центральных учреждений (начальников управлений и заведующих отделами, управляющих трестами и их заместителей, директоров и заместителей директоров промышленных предприятий, совхозов и т. п.), а также состоящих на службе в различных учреждениях инженеров, агрономов, профессоров, врачей, руководителей учебных и научно-исследовательских учреждений — даются по согласованию с соответствующими народными комиссарами.
4. Разрешения на аресты членов и кандидатов ВКП(б) даются по согласованию с секретарями районных, краевых, областных комитетов ВКП(б), ЦК нацкомпартий, по принадлежности, а в отношении коммунистов, занимающих руководящие должности в наркоматах Союза и приравненных к ним центральных учреждениях, — по получении на то согласия председателя Комиссии Партийного Контроля.
5. Разрешения на аресты военнослужащих высшего, старшего и среднего начальствуюшего состава РККА даются по согласованию с наркомом обороны.
6. Разрешения на аресты даются в районе районным прокурором, в автономных республиках — прокурорами этих республик, в краях (областях) — краевыми (областными) прокурорами.
По делам о преступлениях на железнодорожном и водном транспорте разрешения на аресты даются участковыми прокурорами, дорожными прокурорами и прокурорами бассейнов по принадлежности; по делам, подсудным военным трибуналам, прокурорами военных округов.
Разрешения на аресты, производимые непосредственно народными комиссариатами внутренних дел союзных республик, даются прокурорами республик.
Разрешения на аресты, производимые непосредственно народным комиссариатом внутренних дел СССР, даются прокурором Союза.
